An Accra High Court presided by Justice Gifty Agyei Addo Monday dismissed an ex parte injunction application from one of the Rastafarian students denied admission by the Achimota School on March 19, 2021.
The Rastafarians in their suit directed the High court to instruct the Achimota Senior High School Authorities to admit them into the school for them to start academic activities just as their colleague first-year students.
But the court said one of the applicants, Iras Marghuy failed procedurally on both interim injunctions which were to last for 10 days or interlocutory injunction which was to last throughout the hearing of the case.
The court said, there would be a travesty of justice on the respondents considering the application was filed ex parte.
Justice Gifty Agyei Addo in her verdict stated whether the application was for an interim injunction or interlocutory injunction, it cannot be granted.
The Accra High Court however instead of the 21 days allowed by the rules for the respondents to file the responses when served, has given the affected BECE graduate’s a seven days deadline to file the response.
Hearing of the substantive matter has been adjourned to April 22, 2021.
The lawsuit comes after the Headmistress of Achimota School March 19, 2021, denied two first-year students admission citing their dreadlocks goes against Motown rules and the Ghana Education Service code of conduct.
